Este documento establece las condiciones generales de la relaci\u00f3n contractual de intermediaci\u00f3n en la compraventa de los productos ofrecidos en este sitio web, cuyo titular es MAWIRONI, S.L. (en adelante, \u00abMAWIRONI\u00bb), con domicilio social en carrer de la Boix 46, nave 2 del poligono 13 (Sector PAU 27), Mas Alba Ponent, 08870 Sitges, (Barcelona), y NIF B-19499169, inscrita en el Registro Mercantil de Barcelona, Tomo 1000433181465, Folio 1, Hoja B-623127, Inscripci\u00f3n 1, y las personas f\u00edsicas y\/o jur\u00eddicas (en adelante, el \u00abCLIENTE\u00bb) que manifiestan su deseo de adquirir los productos mediante una solicitud en l\u00ednea a trav\u00e9s de este sitio web.<\/p>

La solicitud del CLIENTE de los t\u00e9rminos y condiciones espec\u00edficos a los que se refieren estas condiciones, que deber\u00e1 aceptar en l\u00ednea antes de comprar el Producto, se le informar\u00e1 de estas condiciones en este mismo sitio web para que las lea, imprima, archive y acepte. Estas condiciones generales, junto con la compra del Producto por parte del CLIENTE, implican la formalizaci\u00f3n del contrato de compraventa entre MAWIRONI y el CLIENTE, quien declara haber le\u00eddo, comprendido y aceptado estas condiciones. El CLIENTE siempre podr\u00e1 consultar estas condiciones generales en el sitio web.<\/p>

UNO. LEY APLICABLE:<\/strong><\/p>

Las presentes Condiciones Generales se sujetan a lo dispuesto en la normativa y ley en defensa de los derechos de los consumidores y usuarios, as\u00ed como en materia de contrataci\u00f3n electr\u00f3nica.<\/p>

DOS. OBJETO DEL ACUERDO:<\/strong><\/p>

Mediante las presentes Condiciones Generales, MAWIRONI se compromete a proporcionar al CLIENTE el Producto solicitado en el sitio web a cambio de un precio determinado.<\/p>

Al adquirir el Producto disponible en este sitio web, el CLIENTE declara:<\/p>

a) Considerando que es una persona f\u00edsica mayor de edad y con capacidad para celebrar el presente contrato.
b) Considerando que ha le\u00eddo, comprendido y acepta las presentes Condiciones Generales de Contrataci\u00f3n.<\/p>

TRES. MODIFICACI\u00d3N DE LOS T\u00c9RMINOS Y CONDICIONES GENERALES:<\/strong><\/p>

MAWIRONI se reserva el derecho de modificar estas Condiciones Generales en cualquier momento, sin necesidad de informar previamente al CLIENTE. En cualquier caso, el CLIENTE es responsable de revisarlas como requisito previo a la compra de cualquier producto disponible en este sitio web. No obstante, las Condiciones Generales indicadas en el sitio web al adquirir el Producto se considerar\u00e1n v\u00e1lidas y aplicables.<\/p>

CUATRO. DERECHOS Y OBLIGACIONES DE MAWIRONI:<\/strong><\/p>

4.1. Entrega del producto: MAWIRONI se compromete a entregar el producto en buen estado en la direcci\u00f3n que el CLIENTE indique en el formulario de pedido, que incluye las condiciones espec\u00edficas adjuntas a estas Condiciones Generales. MAWIRONI no se responsabiliza de ning\u00fan error que se produzca durante la entrega si los datos incluidos por el CLIENTE en el formulario de pedido son incorrectos o se han omitido. Las entregas se realizar\u00e1n de lunes a viernes laborables. Los plazos de entrega son estimados y MAWIRONI no se responsabiliza de los retrasos en la entrega. Se realizan entregas en toda Espa\u00f1a, incluidas las Islas Baleares. MAWIRONI no ser\u00e1 responsable de ning\u00fan retraso en la entrega por causas exclusivamente imputables al transportista o por factores imprevisibles o incontrolables a los que no est\u00e9 obligado a someterse.
En caso de no disponibilidad del producto solicitado, MAWIRONI informar\u00e1 al CLIENTE, quien podr\u00e1 recuperar el importe pagado sin demora. La notificaci\u00f3n se realizar\u00e1 por correo electr\u00f3nico o al n\u00famero de tel\u00e9fono proporcionado por el CLIENTE. En ese momento, MAWIRONI podr\u00e1 ofrecer al CLIENTE la opci\u00f3n de sustituir el producto adquirido por otro de caracter\u00edsticas y calidad similares, sin coste adicional.<\/p>

4.2. Responsabilidad de MAWIRONI: En ning\u00fan caso ser\u00e1 responsable en relaci\u00f3n con:<\/p>

4.2.1. Cualquier error, retraso en el acceso del CLIENTE al introducir sus datos o cualquier anomal\u00eda que pueda surgir cuando estos incidentes se deban a problemas de internet, fuerza mayor o cualquier evento imprevisible no imputable a la buena fe de la empresa. En cualquier caso, MAWIRONI se compromete a resolver cualquier problema que pueda surgir y a ofrecer todo el apoyo necesario al CLIENTE para encontrar una soluci\u00f3n r\u00e1pida y satisfactoria al incidente.<\/p>

4.2.2. Cualquier error o da\u00f1o producido por un uso ineficiente y negligente del Producto por parte del CLIENTE.<\/p>

4.2.3. Falta de operatividad o problemas con la direcci\u00f3n de correo electr\u00f3nico de confirmaci\u00f3n del pedido proporcionada por el CLIENTE.<\/p>

4.2.4. MAWIRONI trabaja con un proveedor log\u00edstico externo y sus retrasos log\u00edsticos est\u00e1n fuera del control de MAWIRONI.<\/p>

4.3. Garant\u00edas:<\/p>

En caso de que el producto llegue en mal estado, MAWIRONI se compromete a sustituirlo por uno nuevo. Para ello, deber\u00e1 enviar un correo electr\u00f3nico a info@espumosos.keliam.com con fotos del producto donde se puede apreciar su mal estado.<\/p>

4.4. Derecho de desistimiento:<\/p>

Dada la naturaleza de los productos de MAWIRONI y de conformidad con el art\u00edculo 103 del Real Decreto Legislativo 1\/2007, de 16 de noviembre, sobre Protecci\u00f3n de los Consumidores y Usuarios, el derecho de desistimiento no procede cuando el servicio haya sido completamente prestado, cuando dicha prestaci\u00f3n haya comenzado, con el previo consentimiento expreso del consumidor y usuario y con su reconocimiento de que es consciente de que, una vez ejecutado completamente el contrato por el prestador, habr\u00e1 perdido su derecho de desistimiento.<\/p>

CINCO. DERECHOS Y OBLIGACIONES DEL CLIENTE:<\/strong><\/p>

5.1. Pago: El CLIENTE se compromete a pagar por adelantado el Producto efectivamente solicitado, en la cantidad y forma que se indica a continuaci\u00f3n:<\/p>

5.1.1. Importe: El precio del Producto adquirido por el CLIENTE ser\u00e1 el indicado en el sitio web y se incluir\u00e1 en la solicitud espec\u00edfica que realice en cada momento. Estas solicitudes constituir\u00e1n los t\u00e9rminos y condiciones espec\u00edficos de cada pedido. Los precios de los productos indicados en el sitio web incluyen el IVA.<\/p>

Los gastos de env\u00edo correspondientes deber\u00e1n a\u00f1adirse al precio indicado en el sitio web para cada producto ofrecido. MAWIRONI deber\u00e1 informar al CLIENTE del coste del env\u00edo antes de finalizar la compra y en el correo electr\u00f3nico de confirmaci\u00f3n.<\/p>

5.1.2. Formas de pago: El CLIENTE deber\u00e1 abonar el importe correspondiente a su pedido mediante:<\/p>

sea mediante dep\u00f3sito directo en nuestra cuenta o mediante transferencia bancaria.<\/p>

PayPal: Para lo cual el CLIENTE declara disponer de una cuenta activa con dicho proveedor de servicios de pago, aceptando las condiciones de dicho servicio.<\/p>

Bizum: Para lo cual el CLIENTE declara disponer de una cuenta activa con dicho proveedor de servicios de pago, aceptando las condiciones de dicho servicio.<\/p>

5.2. Responsabilidad del CLIENTE: Ser\u00e1 responsabilidad del CLIENTE:<\/p>

5.2.1. El CLIENTE asume todos los riesgos de desgaste, da\u00f1o, deterioro y p\u00e9rdida del Producto desde el momento en que un tercero le entregue los productos solicitados en nombre de MAWIRONI.<\/p>

5.2.2. El CLIENTE se compromete a comprobar el correcto estado del Producto en presencia del tercero que entregue el Producto solicitado en nombre de MAWIRONI, indicando al mismo tiempo cualquier anomal\u00eda en el embalaje que se detecte.<\/p>

Si una vez revisado el contenido, el CLIENTE detecta cualquier incidencia, como abolladuras, roturas o cualquier desperfecto ocasionado por la entrega, se compromete a comunicarlo a MAWIRONI en el plazo de 48 horas desde la recepci\u00f3n del producto.<\/p>

SEIS. RESPONSABILIDAD:<\/strong><\/p>

6.1. Bajo ninguna circunstancia MAWIRONI ser\u00e1 responsable de:<\/p>

6.1.1. La producci\u00f3n de cualquier tipo de da\u00f1o que el CLIENTE o terceros puedan causar al sitio web.<\/p>

6.2. MAWIRONI se reserva el derecho a suspender el acceso sin previo aviso y de forma discrecional, permanente o temporal, hasta que se pueda garantizar la efectiva responsabilidad por los da\u00f1os derivados. Adem\u00e1s, MAWIRONI deber\u00e1 cooperar con la autoridad competente y notificar estos incidentes tan pronto como tenga conocimiento fehaciente de que el da\u00f1o causado constituye alg\u00fan tipo de actividad ilegal.<\/p>

6.3. Productos y responsabilidad el contenido de los productos<\/p>

i. Mawironi act\u00faa como plataforma de venta y distribuci\u00f3n de productos comercializados por fabricantes y proveedores externos. Las descripciones, ingredientes, composiciones, caracter\u00edsticas, advertencias y cualquier otra informaci\u00f3n relativa a los productos son proporcionadas por los propios fabricantes o proveedores.<\/p>

ii. Mawironi no es responsable del contenido, composici\u00f3n, ingredientes, f\u00f3rmulas, calidad, seguridad, etiquetado ni posibles efectos de los productos comercializados en el Sitio Web.<\/p>

iii. La responsabilidad sobre dicha informaci\u00f3n recae exclusivamente en el fabricante o proveedor del producto. El usuario es responsable de revisar cuidadosamente la informaci\u00f3n del producto antes de su consumo o uso, incluyendo ingredientes, advertencias, al\u00e9rgenos y recomendaciones del fabricante.<\/p>

iv. Mawironi no se hace responsable de da\u00f1os, perjuicios o efectos adversos derivados del consumo o uso de los productos adquiridos a trav\u00e9s del Sitio Web.<\/p>

v. El uso y consumo de los productos se realiza bajo la exclusiva responsabilidad del usuario. En caso de dudas, intolerancias, alergias o condiciones espec\u00edficas, se recomienda consultar con un profesional cualificado antes de consumir cualquier producto.<\/p>

vi. espumosos.es no ser\u00e1 responsable de: Da\u00f1os directos o indirectos derivados del uso o consumo de los productos, Errores u omisiones en la informaci\u00f3n proporcionada por los fabricantes. Incumplimientos atribuibles a terceros proveedores.<\/p>

6.4. Consumo responsable<\/p>

i. Mawironi promueve el consumo responsable de bebidas alcoh\u00f3licas. La venta de productos alcoh\u00f3licos est\u00e1 destinada exclusivamente a mayores de la edad legal permitida seg\u00fan la legislaci\u00f3n vigente.<\/p>

ii. El consumo excesivo de alcohol puede ser perjudicial para la salud. Mawironi no se hace responsable del uso indebido, abusivo o irresponsable de los productos adquiridos a trav\u00e9s del Sitio Web. El usuario asume plena responsabilidad por el consumo de los productos, comprometi\u00e9ndose a hacerlo de forma moderada y responsable.<\/p>

iii. Se recomienda no consumir bebidas alcoh\u00f3licas durante el embarazo, la conducci\u00f3n de veh\u00edculos, el manejo de maquinaria o en situaciones que requieran plena atenci\u00f3n.<\/p>

SIETE. FACTURA ELECTR\u00d3NICA:<\/strong><\/p>

El CLIENTE acepta expresamente recibir facturas electr\u00f3nicas por las compras realizadas en MAWIRONI. La factura se enviar\u00e1 a la direcci\u00f3n de correo electr\u00f3nico proporcionada por el CLIENTE durante el proceso de registro.<\/p>

OCHO. JURISDICCI\u00d3N COMPETENTE Y LEY APLICABLE:<\/strong><\/p>

Las presentes Condiciones Generales se rigen por la legislaci\u00f3n espa\u00f1ola. Se aplicar\u00e1 lo dispuesto en el art\u00edculo 29 de la Ley 34\/2002, de 11 de julio, de Servicios de la Sociedad de la Informaci\u00f3n y de Comercio Electr\u00f3nico, para determinar el lugar de venta al que se aplican las presentes Condiciones Generales.<\/p>

Cuando el CLIENTE no tenga la consideraci\u00f3n de consumidor, cualquier controversia relativa a la interpretaci\u00f3n o ejecuci\u00f3n de las presentes Condiciones Generales de Contrataci\u00f3n se someter\u00e1 a la jurisdicci\u00f3n de los Juzgados y Tribunales de la ciudad de Barcelona (Espa\u00f1a).<\/p>

NUEVE. NULIDAD DE LAS CL\u00c1USULAS:<\/strong><\/p>

En caso de que alguna cl\u00e1usula de estos T\u00e9rminos y Condiciones Generales sea declarada nula, todas las dem\u00e1s cl\u00e1usulas seguir\u00e1n vigentes y se interpretar\u00e1n conforme a la voluntad de las partes y a la finalidad de estos t\u00e9rminos y condiciones. MAWIRONI no podr\u00e1 ejercer ninguno de los derechos y facultades conferidos en este documento, lo que en ning\u00fan caso implicar\u00e1 la renuncia a los mismos, salvo reconocimiento expreso por parte de MAWIRONI.<\/p>

DIEZ. POL\u00cdTICA DE DEVOLUCIONES<\/strong><\/p>

10.1 Responsabilidad del cliente<\/p>

10.1.1 El cliente se pondr\u00e1 en contacto con MAWIRONI en un plazo de 48 horas tras la recepci\u00f3n del pedido.
Aseg\u00farese de incluir:
o Confirmaci\u00f3n del pedido
o Fotos de los productos que desea devolver
o Motivo de la devoluci\u00f3n*<\/p>

10.1.2 Plazo para la devoluci\u00f3n: 14 d\u00edas tras la recepci\u00f3n de los productos.<\/p>

10.2 Motivos no aceptados para la devoluci\u00f3n
– El cliente es responsable de revisar el paquete al recibir los productos. No se aceptar\u00e1n devoluciones de paquetes con signos evidentes de da\u00f1os en el exterior que debieron detectarse al recibir el paquete.
– Producto no conforme a su gusto
– Da\u00f1os m\u00ednimos en las etiquetas, estuches o cajas de regalo
– Da\u00f1os en las cajas de regalo utilizadas para su protecci\u00f3n
– Las etiquetas o los paquetes difieren de las im\u00e1genes del sitio web
– Se ha superado el plazo de devoluci\u00f3n
– La botella ha sido abierta (excepto si el contenido del producto est\u00e1 mal).
o Esta es la \u00fanica excepci\u00f3n en la que podemos aceptar una botella abierta. En este caso, necesitamos recibir la botella abierta devuelta. Por favor, aseg\u00farese de que la botella est\u00e9 bien cerrada y devu\u00e9lvala con el contenido restante.

ONCE: DERECHO DE TERMINAR LA RELACI\u00d3N<\/strong><\/p>

MAWIRONI se reserva el derecho de cancelar la cuenta del cliente si este incumple cualquiera de los puntos anteriores. Nos reservamos el derecho de cancelar la cuenta del cliente en cualquier momento por cualquier uso indebido o inapropiado de estos t\u00e9rminos y condiciones, o por cualquier comunicaci\u00f3n verbal o escrita abusiva dirigida a cualquier miembro del equipo de Atenci\u00f3n al Cliente. Se le informar\u00e1 de dicha cancelaci\u00f3n por escrito. This document sets forth the general terms and conditions for the contractual relationship involving the intermediation in the purchase and sale of the products offered on this website, the owner and proprietor of which is MAWIRONI, S.L. The request by the CUSTOMER form the specific terms and conditions to which these terms and conditions are associated, which the CUSTOMER must accept on line before purchasing the Product. By way of these General Terms and Conditions, MAWIRONI agrees to provide the CUSTOMER with the Product requested on the website in exchanged for a set price.<\/p>

By purchasing the Product available on this website, the CUSTOMER declares:<\/p>

a) Whereas he\/she is an individual of legal age and with the capacity to enter into this agreement.
b) Whereas he\/she has read and understood and accepts these General Terms and Conditions of Contract.<\/p>

THREE. ALTERATION OF THE GENERAL TERMS AND CONDITIONS:<\/strong><\/p>

MAWIRONI reserves the right to amend these General Terms and Conditions at any time, without having to inform the CUSTOMER of such in advance. On all accounts, the CUSTOMER is responsible for reviewing them as a prerequisite to purchasing any product available on this website. The General Terms and Conditions indicated on the website when the CUSTOMER purchases the Product shall, however, be deemed valid and applicable.<\/p>

FOUR. RIGHTS AND OBLIGATIONS OF MAWIRONI:<\/strong><\/p>

4.1. Delivery of the product: MAWIRONI undertakes to deliver the product in correct condition to the address that the CUSTOMER indicates on the order form that includes the specific conditions attached to these General Conditions. MAWIRONI shall not be responsible for any errors arising during delivery when the data included by the CUSTOMER on the order form are untrue or have been omitted. Deliveries will be made from Monday to Friday on working days. Delivery times are estimated and MAWIRONI is not responsible for any delays in delivery. Deliveries are made throughout Spain and the Balearic Islands. MAWIRONI shall not be responsible for any delays in delivery for reasons exclusively attributable to the forwarding agent or unforeseeable or uncontrollable factors for which it is not obliged to be subject.
Where the product requested is unavailable, MAWIRONI shall inform the CUSTOMER of such and the latter may recover the sums paid for the product without undue delay. Notification shall be made by e-mail or to the telephone number provided by the CUSTOMER. At this time, MAWIRONI may give the CUSTOMER the option of replacing the product purchased with another of similar characteristics and of the same quality at no extra cost.<\/p>

MAWIRONI has the right to change promotions and product offers at any moment without any prior notification.<\/p>

MAWIRONI can not guarantee availability of all products as discrepancies in stock or losses and damages might occur<\/p>

MAWIRONI reserves the right to accept or reject any review of any product on its site.<\/p>

4.2. Liability of MAWIRONI: Under no circumstances shall it be held liable in relation to:<\/p>

4.2.1. Any errors, delays in access by the CUSTOMER when entering his\/her details or any abnormality that may arise when these incidents are due to internet problems, force majeure or any unforeseeable event not attributable to the good faith of the company. On all accounts, MAWIRONI agrees to solve any problems that may arise and to offer all necessary support to the CUSTOMER to find a fast, satisfactory solution to the incident.<\/p>

4.2.2. Any errors or damage produced due to inefficient and negligent use of the Product by the CUSTOMER.<\/p>

4.2.3. Non-operability of or problems with the order confirmation e-mail address provided by the CUSTOMER.<\/p>

4.2.4. MAWIRONI works with a third party logistics provider and their logistical delays are out of MAWIRONI control.<\/p>

4.2.5 Boxes for the large format bottles, whilst attractive, are considered to be protective in nature and therefore any damage to these in transit is not eligible for replacement or refund.<\/p>

4.3. Warranties:<\/p>

In the event that the product arrives in poor condition, MAWIRONI undertakes to replace it with a new one. To do so, you must send an email to info@espumosos.keliam.com with photos of the product where its poor condition can be seen. Please refer to our return policy.<\/p>

4.4. Right of Withdrawal:<\/p>

Given the nature of the products of MAWIRONI and in accordance with Article 103 of Spanish Royal Legislative Decree 1\/2007 of 16 November on Consumer and User Protection, the right of withdrawal does not apply when the service has been fully provided, when said provision has started, with the prior express consent of the consumer and user and with their acknowledgement that they aware that, once the contract has been executed in full by the provider, they will have lost their right of withdrawal.<\/p>

FIVE. RIGHTS AND LIABILITIES OF THE CUSTOMER:<\/strong><\/p>

5.1. Payment: The CUSTOMER agrees to pay in advance for the Product effectively requested, in the amount and manner indicated below:<\/p>

5.1.1. Amount: The price of the Product purchased by the CUSTOMER shall be as indicated on the website and is included in the specific request made by the CUSTOMER at any given time. These requests shall form the specific terms and conditions of a given order. The prices of the products indicated on the website include VAT.<\/p>

All appropriate delivery expenses must be added to the price indicated on the website for each of the products offered. MAWIRONI must inform the CUSTOMER of the cost of delivery expenses before the purchase is completed and in the e-mail sent to confirm the purchase.<\/p>

5.1.2. Methods of payment: The CUSTOMER must pay the amount corresponding to his\/her order by way of:<\/p>

– Deposit \/ Bank Transfer: Through our MAWIRONI account, either by direct deposit into our account or by bank transfer. Orders paid via banktransfer will be cancelled if the funds are not received within 10 days after placing the order.<\/p>

5.2. Liability of the CUSTOMER: The following shall be the liability of the CUSTOMER:<\/p>

5.2.1. The CUSTOMER accepts all risks of Product wear, harm, damage and loss as soon the ordered products are delivered to him or her by a third party on behalf of MAWIRONI.<\/p>

5.2.2. The CUSTOMER undertakes to check the correct condition of the Product in the presence of the third party delivering the ordered Product on behalf of MAWIRONI, indicating any anomaly in the packaging that might be detected at that same time.<\/p>

If, once the contents have been checked, the CUSTOMER detects any incident, such as dints, breakages or any imperfection caused by delivery, he or she undertakes to inform MAWIRONI of such within a 48 hours of receipt of the product.<\/p>

5.2.3. The client shall not share log in details and allow others to place orders under their name.<\/p>

5.2.4. Clients shall not write any reviews that are: untrue, misleading, indecent, harassing, discriminating, fraudulent.<\/p>

5.2.5. Customers need to notify the online store maximum 10 days after order confirmation should an order not be received by the client. Failure to do so means the online store is not responsible for any loss nor any compensation or replacement.<\/p>

SIX. LIABILITY:<\/strong><\/p>

6.1. Under no circumstances shall MAWIRONI be liable for:<\/p>

6.1.1. The producing of any kind of damage that the CUSTOMER or third parties may cause to the website.<\/p>

6.2. MAWIRONI reserves the right to suspend access without prior warning and in a discretionary and permanent or temporary manner until effective liability of any damages arising can be ensured. Furthermore, MAWIRONI shall cooperate with and notify the competent authority of these incidents as soon as it becomes reliably aware of the fact that the damage caused constitutes some kind of illegal activity.<\/p>

6.3. Products and responsibility for product content<\/p>

i. Mawironi acts as a sales and distribution platform for products marketed by external manufacturers and suppliers. iii. Responsibility for this information rests exclusively with the product manufacturer or supplier. The user is responsible for carefully reviewing product information before consumption or use, including ingredients, warnings, allergens, and the manufacturer’s recommendations.<\/p>

iv. Mawironi is not liable for any damages, losses, or adverse effects arising from the consumption or use of products purchased through the Website.<\/p>

v. The use and consumption of the products is the sole responsibility of the user. In case of doubts, intolerances, allergies, or specific conditions, it is recommended to consult a qualified professional before consuming any product.<\/p>

vi. espumosos.es will not be liable for: Direct or indirect damages arising from the use or consumption of the products; errors or omissions in the information provided by the manufacturers; or breaches attributable to third-party suppliers.<\/p>

6.4. Responsible Consumption
i. Mawironi promotes the responsible consumption of alcoholic beverages. The sale of alcoholic products is intended exclusively for individuals of legal drinking age as defined by current legislation.<\/p>

ii. Excessive alcohol consumption can be harmful to your health. Mawironi is not responsible for the misuse, abuse, or irresponsibility of products purchased through the Website. The user assumes full responsibility for the consumption of the products, agreeing to do so in moderation and responsibly.<\/p>

iii. It is recommended not to consume alcoholic beverages during pregnancy, while driving, operating machinery, or in situations requiring full attention.<\/p>

SEVEN. E-INVOICE:<\/strong><\/p>

The CUSTOMER expressly agrees to receive e-invoices for the purchases made at MAWIRONI. The invoice shall be sent to the e-mail address provided by the CUSTOMER during the registration process.<\/p>

EIGHT. COMPETENT JURISDICTION AND APPLICABLE LAW:<\/strong><\/p>

These General Terms and Conditions are governed by Spanish law. The provisions of Article 29 of the Spanish Information Society and e-Commerce Law 34\/2002 of 11 July shall apply in order to determine the location of sale to which these General Terms and Conditions are subject.
Where the CUSTOMER is not considered a consumer, any dispute regarding the interpreting or implementation of these General Terms and Conditions of Contract shall be subject to the jurisdiction of the Courts of the city of Barcelona (Spain).<\/p>

NINE. INVALIDITY OF CLAUSES:<\/strong><\/p>

Where any clause of these General Terms and Conditions is declared null and void, all other clauses shall remain valid and shall be interpreted in line with the will of the parties and the purpose of these terms and conditions. TEN. Return policy<\/strong><\/p>

Responsibility of the customer.
Customer will contact MAWIRONI within 48 hours upon receiving the order.

  • Pictures of the goods you want to return<\/li>
  • Reason for returning the goods*<\/li>
  • 10.1.2 Timeframe to return an order: 14 days after receiving the goods.<\/li><\/ul>

    10.2 Unaccepted reasons for returning goods
    – Client has the responsibility to check the package upon receiving the goods. We cannot accept the return of packages with clear outer case signs of damage that should have been detected upon receiving the package.
    – Product not according to personal taste
    – Minimal damages on labels\/cases\/giftboxes
    – Damages to gift cases served for protection
    – Labels\/packages differ from pictures on website
    – Timeframe to return has been exceeded
    – Product has been fully consumed
    -Bottle has been opened (with the exception of a product that is off)
    – This is the only exception where we can accept an opened bottle. In this case we need to receive the opened returned. Please make sure the bottle is closed properly and return the bottle with the content that is left.
    – We cannot accept returns of empty bottles for products that were off.<\/p>

    ELEVEN. Right of termination relationship<\/strong><\/p>

    MAWIRONI has the right to terminate the clients account if the client fails to comply with any of the above. We reserve the right to terminate Customers using our services at any time for whatever we consider misappropriate or improper use of or not abiding by these terms and conditions, and or abusive verbal or written communication to or at any member of the Customer Services team.
